Unfortunately, as I venture to think, the Colonial Secretary gave him other advice, and he has advanced to a position which I do not think is at all in accordance with the views expressed by Your Excellency in paragraph 4 of the letter under reply.

It is the more unfortunate, as it has made me re-consider the view that I have always held of Mr. Seth. I have always been desirous to carry on the Supreme Court with him as Registrar until his retirement, although I have been conscious of his somewhat limited capacities. I have now come to the conclusion that it would be for the good of the service that he should be retired, and the Registry put upon a sounder basis with a more competent head. Only within the last few days I have discovered a very grave act of carelessness. I am thank- -ful to say however it will not produce serious consequences, but this does not diminish the gravity of the position. In order to relieve the Registry I have allowed my clerk to act as Registrar in Court for some period. It now transpires that Mr. Seth has never taken the proper steps to have him authorised to administer the oath to witnesses. The consequence is that for some months the oath has been administered by an unqualified officer. It is clear to me that the Registry needs much more supervision than has hitherto been considered necessary.

One other matter I must refer to in this connection. In your letter of 6th. April, Your Excellency informs me that Mr. Seth has assured Your Excellency that with Mr. Melbourne's half days he will be able to meet the work of the Registry satisfactorily. I must tell Your Excellency that this is different from the information Mr. Seth has invariably given me on the subject of the Deputy Registrars. But putting this on one side, he has ignored entirely the fact that it is only because I have been very complaisant, and desirous to carry things on as smoothly as possible, that I have sat in Court for some months without the proper officer in attendance, and have, at considerable inconvenience to myself, allowed my clerk to take his place.
